Service Description
Mississippi Pest Control provides residential, commercial, and industrial pest management services throughout the state of Mississippi. Our services include, but are not limited to, general pest control treatments for insects and rodents, termite inspection and treatment, mosquito reduction programs, bed bug elimination, wildlife removal, and preventative maintenance plans. Specific services, treatment methods, frequencies, and coverage areas will be detailed in your individual service agreement or work order. All services are performed by licensed technicians in accordance with Mississippi Department of Agriculture and Commerce regulations and applicable federal guidelines. Service appointments are scheduled during normal business hours, with emergency services available in certain circumstances as determined by Mississippi Pest Control. Access to treated properties, both interior and exterior, may be required for service completion. Weather conditions, property accessibility, and other factors beyond our control may affect scheduling and service delivery.
No Guarantee or Warranty
Mississippi Pest Control makes no guarantees, warranties, or representations regarding the complete or permanent elimination of pests from any property. Pest control results vary based on numerous factors including, but not limited to, property conditions, surrounding environment, weather patterns, pest species, infestation severity, and customer compliance with preparation and post-treatment instructions. Any verbal or written statements about expected outcomes are estimates based on professional experience and do not constitute warranties. We do not guarantee against future infestations, re-infestations, or pest-related property damage. Our services represent reasonable efforts to control and reduce pest populations using industry-standard methods and products. No refunds will be issued based solely on the presence of pests following treatment, though we may provide additional services at our discretion under applicable service agreements.
User Responsibilities
As a customer of Mississippi Pest Control, you are responsible for providing accurate information about your property, existing pest conditions, and any known hazards prior to service. You must ensure safe access to all areas requiring treatment, including securing pets, removing sensitive items as instructed, and informing technicians of any health conditions, allergies, or chemical sensitivities of occupants. You agree to follow all pre-treatment and post-treatment instructions provided by our technicians, including ventilation requirements, re-entry timelines, and cleaning restrictions. Failure to comply with these instructions may reduce treatment effectiveness and void any retreatment obligations. You are responsible for maintaining your property in a manner that does not promote pest activity, including proper sanitation, moisture control, and structural repairs. Payment is due according to the terms specified in your service agreement, and you remain responsible for charges regardless of perceived treatment outcomes.
Limitation of Liability
To the maximum extent permitted by law, Mississippi Pest Control shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from or related to our services, including but not limited to property damage, personal injury, lost profits, or emotional distress. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim. We are not liable for damages resulting from your failure to follow instructions, pre-existing property conditions, or acts of nature that facilitate pest activity. This limitation applies regardless of the legal theory asserted, whether contract, tort, negligence, strict liability, or otherwise. You acknowledge that pest control involves inherent uncertainties and agree that our pricing reflects this allocation of risk.
Intellectual Property
All content, materials, trademarks, service marks, logos, trade names, and intellectual property displayed on Mississippi Pest Control websites, marketing materials, and documentation are the exclusive property of Mississippi Pest Control or its licensors. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any such materials without prior written consent. Any feedback, suggestions, or testimonials you provide may be used by Mississippi Pest Control for marketing and promotional purposes without compensation. Our service methods, protocols, and proprietary treatment techniques constitute trade secrets and confidential information protected under applicable law.
Governing Law
These Terms of Service and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Mississippi, without regard to conflict of law principles. Any legal action or proceeding relating to our services must be brought exclusively in the state or federal courts located in Hinds County, Mississippi, or the county where the serviced property is located. You consent to the personal jurisdiction of such courts and waive any objection to venue. These terms are subject to applicable Mississippi consumer protection statutes and regulations administered by the Mississippi Department of Agriculture and Commerce Bureau of Plant Industry regarding structural pest control licensing and operations.
Changes to Terms
Mississippi Pest Control reserves the right to modify, amend, or update these Terms of Service at any time without prior individual notice. Changes become effective immediately upon posting to our website or other notification methods. Material changes affecting existing service agreements will be communicated with reasonable advance notice when practicable. Your continued use of our services following any changes constitutes acceptance of the revised terms. We encourage you to review these terms periodically. The most current version will always be available upon request and will supersede all prior versions. Disputes arising before the effective date of any changes shall be governed by the terms in effect at the time the dispute arose.
